0) Definitions

“Member”
: A person with an active Padel Park membership.
“Open Match”: A Padel Park match type that fills places individually.
“Whole Court Booking”: A booking made for the entire court by a single booker.
“Wallet”: Padel Park account balance/credit.
“We/Us”: Padel Park Limited.

1) Acceptance & Scope
By using Padel Park facilities or services — including court bookings, memberships, events, website, or app — you agree to these Privacy Policy and Safeguarding Policy. Continued use after updates confirms your acceptance.

2) Eligibility, Minors & Health
2.1
You confirm you are 16+, or you have parental/guardian consent (U16 Declaration) for solo play. Under-14s must be supervised on-site by a responsible adult.
2.2 You declare you are fit to participate and will not play if unwell or advised against exercise.

3) Membership Cooling-Off
New memberships can be cancelled within 3 days of activation for a full refund. No admin fee applies. This does not apply where prohibited by law.

4) Risk, Consumer Rights & Liability
4.1
Padel and pickleball are physical sports with inherent risks, including but not limited to slips, impacts from balls/rackets/players, and contact with walls or playing surfaces.
4.2 You participate at your own risk and will follow all safety instructions and signage.
4.3 Consumer Guarantees Act 1993 (CGA): Nothing in these Terms limits your rights under the CGA.
4.4 ACC: Personal injury is generally covered by ACC; ACC does not cover property loss.
4.5 To the extent permitted by law, our liability for non-personal injury claims is limited to the amount paid for the affected booking or service.

5) Force MajeureWe are not responsible for service interruptions or changes caused by events beyond our reasonable control, including but not limited to severe weather, pandemics, power or network outages, or facility issues. Refunds or credits are at our discretion.

6) Bookings, Payments, Stored Cards & Fees
6.1 Payment at booking:
All bookings must be paid in full at the time of reservation via Stripe or Wallet, where available.
6.2 Wallet use: Wallet can be used for coaching, pro-shop, and bookings. Wallet cannot be used for memberships or vending purchases.
6.3 Card storage and payment provider: Stored card details are securely managed by Stripe and are subject to Stripe’s own terms and conditions. Padel Park does not, under any circumstances, store, hold, access, or retain full card numbers on any Padel Park website, app, system, or platform.
6.4 Authority to charge stored cards or Wallet balance: By agreeing to these Terms & Conditions, you authorise Padel Park to charge any stored card held securely through Stripe, or deduct funds from any existing Wallet balance on your Padel Park account, where any booking, booking share, invited player payment, guest payment, or other amount remains unpaid.
6.5 Responsibility of the court booker: The person who books the court is responsible for ensuring payment of the full court cost. This includes payment for all players invited to the booking, whether they are invited through the Padel Park website, app, booking system, or added as guests. If an invited player or guest does not pay their share, the person who booked the court remains liable for the full outstanding court cost.6.6 Responsibility of invited players: Any player invited to a booking is responsible for paying their share of the booking cost, where applicable. If an invited player does not pay, Padel Park may seek payment from either the invited player or the person who booked the court.
6.7 Unpaid booking payment process: Where a booking or part of a booking remains unpaid, Padel Park may follow the process below:a. Padel Park will first attempt to charge the invited player or players, if applicable, using any stored card held securely through Stripe or any available Wallet balance on their Padel Park account.b. If payment cannot be taken from an invited player due to no stored card, insufficient Wallet balance, failed payment, or any similar reason, Padel Park may send that invited player a notification and payment link requesting payment.c. If the invited player has not paid the outstanding amount within one week, Padel Park may charge the outstanding amount to the person who booked the court using any stored card held securely through Stripe or any available Wallet balance on their Padel Park account.d. If payment cannot be taken from the person who booked the court due to no stored card, insufficient Wallet balance, failed payment, or any similar reason, Padel Park may send the person who booked the court a notification and payment link requesting payment.e. If the outstanding amount remains unpaid, a debt may be recorded against both the account of the person who booked the court and the account of the invited player. If either party pays the outstanding amount, the debt will be cleared from both accounts.
6.8 Account debt and restrictions: Any person with an outstanding debt of more than $5 on their Padel Park account may be restricted from making bookings, joining bookings, or playing at Padel Park until the outstanding debt is paid in full.
6.9 Failed or outstanding payments: Padel Park reserves the right to recover any unpaid booking amounts, failed payments, chargebacks, or outstanding account balances. This may include restricting access to bookings, events, leagues, coaching sessions, casual play, or other Padel Park services until payment has been received. We may also recover reasonable costs associated with failed payments, chargebacks, or debt recovery.
6.10 Cancellation windows:General non-members: cancel at least 12 hours prior for a full refund.Members: cancel at least 6 hours prior for a full refund.Coaching sessions: cancel at least 24 hours prior for a full refund.Classes or tournaments: cancel at least 12 hours prior for a full refund.
6.11 Open Match auto-cancellation: If fewer than four players are registered at T-6 hours, the match is automatically cancelled and participants are refunded. If four or more players remain at T-6 hours, the match proceeds and the court cost is split among the players on the booking.
6.12 Whole Court Bookings — payments: The booker is responsible for all outstanding amounts. If guests fail to pay, the booker may be charged the remaining balance.
6.13 No-shows and late arrival: There is a 15-minute grace period from the booked start time. After 15 minutes without play commencing, the booking may be released to others and payment is forfeited.
6.14 Prices: All prices are in NZD and GST-inclusive.

7) Refunds & Cancellations
7.1
Refunds will follow the applicable booking cancellation policy set out in these Terms.
7.2 General bookings may be cancelled at least 12 hours before the booked start time for a full refund.
7.3 Members may cancel bookings at least 6 hours before the booked start time for a full refund.
7.4 Coaching sessions may be cancelled at least 24 hours before the scheduled start time for a full refund.
7.5 Classes or tournaments may be cancelled at least 12 hours before the scheduled start time for a full refund.
7.6 If Padel Park cancels a booking, for example due to safety, maintenance, weather, facility issues, or operational reasons, we will offer a credit or full refund.
7.7 No refunds will be given for no-shows or cancellations made inside the applicable cancellation window, unless we decide otherwise or are required to do so by New Zealand consumer law.
7.8 Unless otherwise required by law or agreed by Padel Park, all refunds will be added to the person’s Padel Park account balance within our website, app, or booking platform.
7.9 This includes refunds or credits relating to court bookings, open matches, coaching, classes, tournaments, padel or pickleball hire, pro-shop purchases, and vending machine purchases.
7.10 Refunds to an external payment method may be provided at Padel Park’s discretion or where required by law. Where an external refund is approved, please allow up to 10 business days for processing.

8) Code of Conduct & House Rules
8.1
Respect others. Abuse, intimidation, discrimination, or antisocial conduct will not be tolerated.
8.2 Footwear: Clean, non-marking court shoes with good lateral support are required. No studs, heels, or black-soled marking shoes.
8.3 Alcohol, smoking and vaping: Do not bring alcohol onto the premises. We may sell alcohol in future under a licence. Smoking and vaping are prohibited inside and in signed areas.
8.4 Equipment and facilities: Use equipment and facilities with care. You are liable for damage you, or your guests, cause. Cleaning or damage fees may apply.
8.5 Access codes and after-hours access: Codes are for your booking group only. Do not share access codes beyond your group or allow tailgating. Do not prop doors open. Breaches may lead to suspension.
8.6 Dogs: Dogs are welcome off-court only. Please clean up after your dog. We reserve the right to revoke dog access for non-compliance.

9) Guest Responsibility — Whole Court Bookings
If you book a whole court, you are responsible for your guests’ conduct, compliance with safety requirements, payments, and any damage they cause. Any breach or cost attributable to guests may be charged to the booker.

10) Privacy & Media Use
10.1

10.2 Photos or videos may be taken for promotional purposes. To opt out, inform staff in person and we’ll note it on your account and take reasonable steps going forward.

11) Membership Photo Requirement
For security and identification, members may be asked to provide a profile photo. No facial recognition is used. Photos are used only to verify membership use and are retained for the duration of the membership plus 24 months, then deleted or anonymised.

12) Intellectual PropertyAll branding, logos, content and software are the property of Padel Park or its licensors. Do not copy, redistribute, or use our intellectual property without written permission.

13) Insurance & Personal Property
13.1
You are responsible for your belongings. We are not liable for lost, damaged, or stolen items.
13.2
We recommend personal insurance for your health and gear.

14) Suspension or Termination
We may suspend or terminate accounts, with or without notice, for breaches of these Terms, venue rules, safety concerns, misuse, non-payment, or unlawful activity. Action is discretionary and may be immediate for serious violations.

15) Changes to Terms
We may update these Terms at any time. Changes take effect when published on our website or app. Continued use constitutes acceptance.

16) Governing Law & Jurisdiction
These Terms are governed by New Zealand law. Disputes are subject to New Zealand jurisdiction. We prefer to resolve issues informally, first see our Privacy Policy and Safeguarding Policy.

17) Entire Agreement
These Terms, together with our Privacy Policy (find it here) and Safeguarding Policy (find it here), form the entire agreement between you and Padel Park.

19) Dispute Resolution
19.1
Email comments@padelpark.nz  with your concern. We aim to acknowledge within 3 business days and resolve within 14 business days. Please refer to our Complaints Procedures Policy.
19.2 If unresolved, we will invite you to a mediation meeting within a further 14 days.
19.3 If mediation is unsuccessful, you may escalate to the NZ Disputes Tribunal, for claims under the statutory threshold, or the courts.

20) Promotions, Vouchers, Wallet & Bundles
20.1 Validity:

Unless otherwise stated, vouchers, promo codes, and bundles are valid for 12 months from issue.
20.2 Single use and stacking:
One code or voucher may be used per booking unless the offer states otherwise.
20.3 Cash value:
Vouchers, promo codes, Wallet credit, and bundles are not redeemable for cash, non-transferable, non-reloadable, and cannot be resold.
20.4 Where usable:
Unless an offer says otherwise, vouchers, promo codes, and Wallet credit may be used for bookings, coaching, and pro-shop purchases. They cannot be used for memberships or vending purchases, unless Padel Park decides otherwise. Refunds or credits relating to vending machine purchases may still be added to a person’s Padel Park account balance.
20.5 Fraud prevention: We may cancel any voucher or code suspected of fraud, misuse, or breach of these Terms.
20.6 Lost or stolen vouchers/codes: We are not liable for lost or stolen vouchers or codes unless issued to a named user account.
20.7 Minimum spend and blackout dates: Offers may specify minimum spend or blackout dates, including but not limited to tournaments or special events. Terms will be stated in the offer.
